I won't be at there on Wednesdays anymore. Not until I get another car. The claim is currently in an internal arbitration because the girl that hit me says I was speeding even though the cops say I wasn't. So her claims adjuster is trying to place SOME negligence on me. My claims adjuster is fighting against that saying I was 0 % at fault. Just have to wait for the Rob... err I mean police report to officially show I wasn't speeding. She was ticketed for failure to yield or some shit.
In any case, I can't get a car until the inspection is complete which should be sometime next week. I'm also unable to get a rental car because fault is unknown at this time. They want to put it all on my insurance just to speed up the claim and avoid as many storage fees as possible but I'm fighting against that because it wasn't my fault and I know how the game works. She has the same insurance I do and Geico claims service is handled by a bunch of monkeys....
So there it is, I figured I'd bring you all up to date.

Yes, Geico sucks monkey balls. But, as I recall CT is an at fault state, correct? Either you're at fault or you are not. If she was ticketed, it doesn't matter if she contests anything. Besides, how the fuck could she know if you were speeding, did she have a radar gun aimed at your car as she fucking plowed into you?!? Dumb Cunt!
Furthermore, the fact that this is in "internal arbitration" with both of you being insured by Geico, Geico is fighting with itself. This is a great point for how fucked up the insurance industry is, no matter what, Geico has to pay the claim, they're just going to fight amongst themselves for a few weeks before they come to the conclusion that no matter what they have to pay out. Assholes.
I hope you've secured a good lawyer. Might I suggest a lawyer in North Haven that regularly deals with Geico and wins? I believe your dad recommended him because he's really good at what he does.
Either way, this shit sucks and I hope things turn out for you.

Thanks. I have talked to the legal clerk about it and they are reviewing the case. Someone should contact me at some point to let me know if they are taking the case. Regarding the insurance. Ct is an at fault state but it's not just cut and dry like that. There are percentages to how much someone is at fault in an accident. Right now they have determined the girl to be 75% at fault in the accident. Her adjuster is trying to prove there was negligence on my end to give me 25% of the fault. Which means both our insurance premiums increase giving the company more money in the end. It's a corrupt business but it is what it is.
I do have the advantage of not having a ticket and having the (rob) police on my side. If I go with what my adjuster was saying all they need is the police report and that will settle up. They seem to recognize that anytime someone is at fault in a collision that they always say the other person was speeding because they don't want to accept full liability. Exact words from my adjuster. They only reason they are investigating is because of the girls claim that I was speeding. They have to investigate from an insurance standpoint. If they didn't fight it they would be doing their jobs.
The police report should be done today if not within a couple days according to the police. I submit that to the insurance. They make a decision based off of that which, according to my adjuster, won't take long... we'll see what happens. The inspection on my car should be this week as well. Then it's just a matter of paperwork at that point. It's total bullshit and I will be looking for other insurance after this because even though geico is cheapest for me in the event I need them they FAIL.

Fucking insurance. Hopefully your adjuster clears this all out and the police report validates all of your claims. It's just that since I've recently gone through this shit I feel your pain and it's all such aggravating bullshit.
Now you have to go through the mess of dealing with a wreck and buying a new vehicle, none of which is fun. Not to mention the potential injuries and stiffness and soreness of the whole thing.
You're probably better off without Geico in the future.

So. As it stands right now. The inspection was done. Car is totaled. So that's a plus in this mess now. Got the police report. To sum it up. Girl says I was "flying" through the intersection and struck her as she tried to turn. lol Cops issued citation saying she failed to yield to traffic that had the right of way. No citations issued and no further action to driver 2 (me). The report is getting faxed today and should be handled on wednesday by Geico. Claim should be settled by Friday.
That's if all goes as planned and no one wants to pursue anything after that. It's pretty cut and dry at that point. Only way this can get messy is if the girls adjuster wants to push the issue and they settle with me being partly negligent. Insurance companies don't have to follow the police report or citations when determining fault. Their own investigations handle that. SO there is still a chance this can go shitty. Although I'm being reassured by my own adjuster that I'll be 0% and the other girl will be 100% at fault. Here's to hoping. Even if it does turn shitty that's what a lawyer is for. I'll fight it. I got nothing else to do...

It will all work out, it just sucks that it happened at all. Hopefully you'll be able to get another vehicle that's nice and fits your budget for gas and shit.
As for Wednesday being a miss, that's fine, I'm not feeling very well myself. Work has been busy and I keep fighting off tension headache after tension headache.

Fuck insurance... I'm pretty sure I've ruined several peoples days simply because insurance companies are lazy fucks. They're quick to tell MVD when no one is paying, but once you catch up on payments, they take their sweet ass time updating the MVD, and I get left looking like a rat-bastard fuck for enforcing a department policy and handing out tickets.

It's very true. The moment a policy cancels or lapse its all electronic. Notice goes out to the state and thats it. When you get up to date it takes at least 7 days to process and report back to the state. That's assuming the report is actually sent. Because again, its all electronic. It doesn't touch a humans hands until that ticket is issued or the mvd mails the customer a nasty gram. Then they have to call. Get a rep that doesn't know what to do but says he does. Then when it doesn't get handled 2 weeks later they get a fine from the mvd. Then they callback. Get someone that hopefully will handle it. They send the notice over and then 5 days later it's processed.
Unless you get me. Then I can file directly with the states computers. =) Yay me...

Just to bring you all up to speed. At this point I won't be around Wednesdays for a while. I'm holding off getting another car for several months. Looking at some point in September/October. Around there or maybe sooner. Depends on some stuff.

The payout is fine. I have gap coverage so I'm good there. They still haven't made a decision on the claim. The decision to wait was mine. Nothing to do with the insurance. At this point the money I save from not having a car payment and insurance is going to be used as a downpayment. That way with something substantial to put down my monthly payment with be better.
Also I pay off a major debt in August from bank of america. That frees up a good chunk of cash which will give me a little more wiggle room as far as what I can do for a monthly payment. Overall just put me in a much better financial position. Still not a good one. But an improved one.
